VACATION RENTAL POLICIES AND RENTAL AGREEMENT

RESIDENTIAL LEASE

This lease agreement dated ________, ____, 2008, entered into by and between the "Owner" acting through her "Agent" as the "Lessor" and the Tenant" acting herein as the "Lessee" hereby lease to the Tenant acting as the "Lessee",  the real property of the "Owner" located at Avenida de Las Garzas No. 3, Colonia Colinas de Pedregal, in San Miguel de Allende, Guanajuato., Mexico 37700 herein defined as the “Premises”. The telephone number of the Premisese is (415) 1523648. This lease shall be for a term ____ calendar nights and days (the Lease Term"), beginning _____, ____ 2008. starting at 1pm (the day of "Entry" or "Arrival") and leaving ____2008/09 before 10 am (the day of "Departure"). The rent payable under this Agreement is $____ USD  (the Lease Price") plus a 6% Mexican tax, payable in USA Dollars or Mexico Pesos, There will also be a charge of  five (5)percent calculated on the "Lease Price", payable  in USA Dollars or Mexican Pesos. This lease may not be renewed without the prior written agreement of Agent and Tenant. A down payment of ($_____________) which is 1/2 of the "Lease Price" of $______________USD needs to be paid no more than 7 days after Tenant receives the "Confirmation of Reservation" from "Agent" with respect to the rent due hereunder. The balance of $____ USD needs to be paid 45 days prior to arrival along with Security Deposit $_________)  has to be paid. Please initial that you agree__________:

CANCELLATION POLICY Reservation my be be cancelled provided it is in writing and not delivered to "Agent" later than 120 days prior to your arrival to be eligible for any refund. If cancelled in writing prior to the 120 days to be eligible for a full refund (less a processing fee) the "Premises" must be re-rented by "Agent"  at the same rental rate and term for the period reserved, if not re-rented then 25% of the rental rate will be applied as a cancellation fee.. If cancelled less than 120 days prior to day of Arrival" your rental deposit is non- refundable. All cancellations or adjustments in dates are subject to a $100.00 US processing fee. Early departure does not warrant any refund of rent or deposit.

SECURITY DEPOSITS At least forty-five (45) days prior to the first day of the "Lease Term" a security deposit of 1/2 the "Lease Price" in USA dollars will be paid to "Agent" by "Tenant". The security deposit is not to be construed as rent and will be returned to the Tenant upon compliance with the following conditions: no charged long distance phone calls, local calls not over the 100 free ones, payment of all rent due, the "Premises" left in a clean, habitable condition, the return of all keys, and removal of abandoned articles. The "agent" is authorized by the "Tenant" to perform those deductions deemed appropriate by her from the "Deposit" for any damage done to the "Primses" (normal wear and tear excepted) including scratches, burns, stains, holes in walls, as well as damage to personal property. Also there will be a $10.00 USD charge for each key not returned. If the house does not have special tipping instructions please go by the following tip procedures: Party of 2 will tip each household staff member $160.00 pesos per week, if you are particularly pleased with the staff’s level of service. Please tip with Mexican currency only. 

Please initial that you agree __________. After Tenant has compiled with the above conditions, the Agent shall forward to Tenant the balance of the deposit. Due to the fact that telephone bill is not sent until the following month, the security telephone deposit cannot be returned until said bill is received, approximately 3 months after departure. ****It is necessary to use your calling card or to call collect. Most of the phones at the home are for local calls only.***** If there are charges you will be assessed a $15.00 USD service processing charge in your bill. It is understood that only registered guests covered by this contract are allowed to stay in the home and on the premises. If the maximum occupancy is exceeded and/or if damages are done to the home in excess of normal wear and tear you shall be subject of forfeit the security deposit or a portion thereof. CARE AND MAINTENANCE Tenant accepts the Premises in their present condition and agrees to take good care of the Premises and not to make any alterations, additions, repairs, or improvements and/or remove any of Owner’s personal property from the Premises, without the prior approval of Agent (even in the event that any portion of the Premises or Owner’s personal property is out of repair) and to promptly reimburse Agent for any damage to the Premises or to owner’s personal property caused by the negligence, misuse, or any other occurrence attributable to Tenant, family or guests. Any damage caused by the removal of the Tenant’s personal property shall be repaired and paid for by the tenant immediately upon demand therefore by Agent. Tenant shall pay reasonable attorney’s fees and court costs, if any, incurred by the Agent in enforcing this contract in court or otherwise, in addition to the amounts otherwise payable under this paragraph. Unless otherwise mentioned herein, all electricity used in or about the Premises shall be for the account of owner and paid for by Agent. The Residence Owner will provide cleaning supplies upon arrival after that tenant is responsible for purchase them. Owner will supply full tank(s) of propane gas for cooking, gas space heaters, gas fireplaces and water heater(s). Additional gas usage beyond initial tank(s) will be for account of the Renter. Gas for swimming pool and/or Jacuzzi will be at the tenant expense. . All cellular, long distance telephone calls and calls over 100 calls per month shall be paid by Tenant. The salary of any maids, gardeners, or other servants employed, by Owner to maintain the Premises shall be for the account of Owner and paid by Agent. Overtime hours worked by each household staff member, shall be charged to the account of the Tenant at the rate of $50.00 pesos per hour. Work performed on Sundays, and holidays shall be charged at the rate of $100.00 pesos per hour. Firewood is for the account of the Tenant. Please initial that you agree ___________. NEITHER THE PREMISES, NOR ANY PORTION OF THEM MAY BE SUBLET BY TENANT TO ANY PERSON WITHOUT THE PRIOR WRITTEN CONSENT OF AGENT. Any complaints which Tenant may have concerning the Premises shall be directed to the Agent during their regular working hours 9:00 a.m. to 5:00 p.m. Monday through Friday, Saturday 10:00 am to 2:00 PM, and only if there is an emergency after hours or on the weekends. Tenant shall use the Premises solely for tenantial purposes. The Premises shall not be occupied by more than (4 persons) The number of guests staying over night must not exceed the maximum occupancy that the unit sleeps. If this is exceeded, you will be asked to check out, pay additional charges and/or be subject to a deposit forfeiture. No pets allowed. Holding Over: The tenant shall be subject to a daily holdover charge of not less than two (2) times the prorated daily rate per this lease, plus any adjustments, costs or charges if other Tenants are denied access to premises and other accommodations are required to places said Tenants. Please initial that you agree___________________ Agent will have the right to show the Premises to prospective clients at the Tenant’s convenience upon at least 24 hours advance notice and shall have the right to inspect the Premises after prior notice to Tenant if Agent has reasonable cause to believe that Tenant or any other person is misusing or damaging the Premises or any furnishing therein. This lease may be amended only by a written agreement executed by Agent and Tenant; merges all prior discussions, understandings and agreements, whether written or verbal, between the parties; shall be governed by and interpreted under the law of the Republic of Mexico, the jurisdiction to which Agent and Tenant hereby expressly submit themselves to the exclusion of the jurisdiction of any other court where ever located. Premier House of San Miguel, S.C. assumes no responsibility for loss, damage or injury to person, property or otherwise resulting directly or indirectly from acts of God or occurrences outside of the direct control of .Premier House of San Miguel, S.C, or from improper of insufficient passports, visas or other documents, delays, cancellations or changes in the guests itinerary or schedule. Tenant hereby acknowledges that neither HOMEOWNER or Premier House of San Miguel, S.C., is responsible for any kind of injury or accident to Tenant, Guests or visitors on the premises. The owners reserve the right to change the reservation to a property of equal value, depending on availability if the reserved property becomes unavailable due to circumstances outside the control of the owners. In no event shall Agent or Owner be liable to Tenant for consequential or indirect damages or for pain or suffering incurred by Tenant in connection with this lease or of the leased Premises. This agreement shall be governed solely and exclusively by the laws of the Republic of Mexico, excluding its conflict of laws rules, and the parties hereto expressly waive the jurisdiction of any court other than the court located in the State of Guanajuato, Mexico and agree to submit to the jurisdiction of said court to the exclusion of all other courts and dispute arising hereunder. CHECK IN TIME IS AFTER 1:00 PM *** CHECK OUT TIME IS BEFORE 10:00 AM. NO PETS AND NO SMOKING allowed, unless otherwise stated. The number of guests must not exceed the maximum occupancy allowed. If the above policies are not adhered to, you will be asked to check out and all monies will be forfeited. Premier House Rentals of San Miguel, will not be held responsible for acts of theft, vandalism, or other damages to the guests personal property of items left in the house.

You will receive a contract by fax or email. Please sign that you agree to all items and return the lease to our office. If we have not received this signed contract prior to your arrival, you will be asked to sign one upon your arrival.

ARRIVAL INFORMATION: It is necessary that you inform us of your exact arrival times, so that we can arrange your entry into the house. If your arrival is on Saturday or Sunday or after 2pm during week days a tip is required. Cleaning supplies and bathroom supplies will be provide upon arrival. After that, tenant must purchase their own.

Tip for house staff is not included in fare. Please read contract on this matter.

Gas for heating pool is not included - ask upon your arrival for rates.
